The Supreme Court has clarified several important issues of law relating to the transfer of property through “haq mahr” (dower).
Justice Shakeel Ahmed delivered the written judgment.
It held that a joint owner of jointly owned property could not transfer anything more than his rightful share of the property. Moreover, he said that while adding his share in haq mahr, a man can’t sell a house as a joint asset.
In addition, the court ordered the marriage registrar and Nikah officials to check the ownership of the property given as haq mahr.
To avoid future legal complications, the court recommended adding a separate section in marriage certificates for property ownership details.
Copies of the verdict have been sent to the chief secretaries of all provinces for implementation.
The Supreme Court also dismissed a civil petition that challenged a decision of the Peshawar High Court (PHC) related to the case.
