The Sindh High Court (SHC) has issued a written order on a petition seeking the formation of a Joint Investigation Team (JIT) to investigate the death of Mir Raza Ali.
The petition was filed by Mir Raza Ali’s parents and sister. A case carrying charges of kidnapping and murder has been registered at Ferozabad Police Station.
The court observed that several legal questions need to be addressed before a decision can be made on the petition.
The SHC questioned whether it has the authority to directly order the constitution of a JIT. It also sought clarification on whether the court can supervise or influence an ongoing investigation and the process of submitting the investigation report.
The court further questioned whether there is any legal basis for intervention in the matter in the absence of a notification under the relevant Inquiry Ordinance.
The SHC issued notices to the Advocate General Sindh, Prosecutor General Sindh and Deputy Attorney General, directing them to assist the court on the legal questions.
The parties have been summoned for the next hearing on August 31.
The court directed all parties to assist in addressing the legal questions at the next hearing before proceedings further with the petition.
