ISLAMABAD: Three prisoners at Adiala Jail have challenged an Islamabad High Court (IHC) decision before the Federal Constitutional Court (FCC), seeking medical and communication facilities similar to those available to Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan.
The prisoners — Ilyas Khan, Muhammad Ismail and Awais Altaf — have petitioned the constitutional court to declare the IHC’s decision void.
They argued that Article 25 of the Constitution guarantees equality before the law and urged the court to direct authorities to provide them with medical facilities available to the PTI founder.
The petitioners cited a Supreme Court order directing the transfer of Imran Khan to Shifa International Hospital on August 18 and sought similar permission for their treatment at the private hospital.
They also requested permission to communicate with their family members living abroad through WhatsApp, claiming that such facilities had been allowed to the PTI founder.
Justice Muhammad Asif of the IHC had heard separate petitions filed by the three prisoners seeking treatment at private hospitals and permission to communicate with relatives overseas.
In its written verdict, the high court observed that imprisonment entails lawful restrictions on an individual’s freedom and that every technological facility cannot be treated as a fundamental right.
